Agave Loco files trademark suit against California wine company

(ChicagoBusiness) - One of Chicago's fastest-growing companies sued a California wine company, alleging that it infringed on a trademark for its signature family of alcoholic drinks.
Vernon Hills-based Agave Loco, which makes the alcoholic beverage RumChata, alleges that Cheers Wine & Spirits of Paso Robles, Calif., began marketing an Italian wine under the brand name Lemonchatta“long after” Agave Loco launched its product “in order to cause confusion, mistake or to deceive customers,” according to a suit filed June 9 in federal court in Chicago.
Agave Loco says the use of the “-chatta” suffix mimics its own products, including RumChata and YumChata. Further, Agave Loco says in the suit, it plans to expand its line and has filed trademark applications for other products including JavaChata, MochaChata, FrappaChata and Cafe con Chata. The company says it has spent “considerable time, resources and effort in promoting the product,” and as a result has built substantial brand recognition and developed valuable intellectual property rights around its products bearing the “Chata” marks.
Agave Loco wants an injunction barring Cheers Wine & Spirits from using any brand that carries a descriptive term followed by “chata” or “chatta,” including Lemonchatta. The company also wants Cheers to destroy all merchandise and promotional materials bearing the marks; hand over to Agave Loco all profits derived from the sale of the products, plus interest; and cover all attorneys' fees.
